Welcome to VerifyBTC. These Terms of Service ("Terms") govern your access to and use of the VerifyBTC website and services located at verifybitcoin.io (the "Service"), operated by Digital Macchiato LLC ("we," "our," or "us"), a Wyoming limited liability company.
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" include that organization.
2. Description of Service
VerifyBTC provides a Bitcoin ownership verification service. Our Service allows:
Brokers and businesses to create verification requests for Bitcoin addresses
Bitcoin holders to prove ownership by signing cryptographic messages
Verification of signatures to confirm that a party controls a specific Bitcoin address
The Service facilitates verification through cryptographic message signing. It does not transfer, hold, or have access to any Bitcoin or cryptocurrency.
Important Security Guarantee: VerifyBTC never collects, stores, processes, transmits, or has access to your Bitcoin private keys, seed phrases, wallet passwords, or any other credentials that could be used to access or move your funds. The verification process uses only cryptographic message signatures, which mathematically prove ownership without exposing private keys. Your Bitcoin remains completely under your control at all times.
3. Account Registration
Eligibility
You must be at least 18 years of age to use this Service. By registering for an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We recommend enabling two-factor authentication (2FA) for enhanced security.
Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
4. Acceptable Use
You may use the Service only for lawful purposes. You agree not to use the Service:
In violation of any applicable law or regulation
To facilitate fraud, money laundering, or terrorist financing
To harass, abuse, or harm another person or entity
To impersonate another person or entity or misrepresent your affiliation
To interfere with or disrupt the Service or servers or networks connected to the Service
To attempt to gain unauthorized access to any part of the Service
To use automated means (bots, scrapers, etc.) to access the Service without our permission
To transmit viruses, malware, or other harmful code
We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including terminating their account and reporting them to law enforcement authorities.
5. Service Limitations and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Guarantee of Accuracy
While we strive to provide accurate verification results, we do not guarantee the accuracy, completeness, or reliability of any verification. Bitcoin ownership verification depends on cryptographic signatures and blockchain data that we do not control.
Not Financial or Legal Advice
The Service does not constitute financial, legal, tax, or investment advice. You are solely responsible for evaluating any verification results and making your own decisions. We recommend consulting with qualified professionals for significant transactions.
Service Availability
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may suspend or discontinue the Service at any time without notice.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Digital Macchiato LLC and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service.
7. Payment Terms
Subscription Plans
Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. Fees are billed in advance on a monthly or annual basis depending on your selected plan.
Payment Processing
All payments are processed by Stripe, our third-party payment processor. By providing payment information, you agree to Stripe's Terms of Service.
Refunds
All fees are non-refundable except as required by law or at our sole discretion. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period.
8. Termination
Termination by You
You may terminate your account at any time by using the account deletion feature in your settings or by contacting us at legal@verifybitcoin.io. Upon termination, your right to use the Service will immediately cease.
Termination by Us
We may suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. We will make reasonable efforts to notify you before termination unless immediate action is required to protect the Service or other users.
Effect of Termination
Upon termination, your access to the Service will be revoked and we may delete your account data, except as required by law or legitimate business purposes (such as maintaining verification records for compliance).
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL MACCHIATO LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Digital Macchiato LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Wyoming.
12. Dispute Resolution
Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@verifybitcoin.io. We will attempt to resolve the dispute within 30 days.
Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Wyoming, and the arbitrator's decision shall be final and binding.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
